Event Waiver

By participating in any Nightmare on Main Street (“NoM”) activities, you assume all risks andhazards associated with this event. In addition, everything at Nightmare on Main features uneven surfaces and inadequate lighting, with numerous obstacles and structures that posepotential hazards. You assume all risks and responsibilities upon stepping foot on our site at 34 West Main Street, Pulaski, Va 24301, waive Nightmare on Main, New River Community Action, Inc., its owners, and agents of any and all responsibilities, including and not limited to death, any injury or permanent impairment, as well as the owners of the property, its entities, agents and staff. Failing to adhere to any of the rules posted or to follow instructions by Nightmare on Main management regarding the attractions or events will result in your removal from the property or limit your participation in future events. You agree to RELEASE, WAIVE,AND DISCHARGE ANY CLAIMS against Nightmare on Main, New River Community Action, Inc., and their directors, owners, employees, as well as the property owners, its entities, agents, and staff (RELEASEES) of any and all liability, claims, demands, causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or your minor child(ren), or to any property belonging to you, while on or upon the premises of and Nightmare on Main, and that it is your expressed intent that thissigned release shall bind the members of your family and spouse, if you are alive, and yourheirs, assigns and personal representative, if you are deceased. You hereby further agree thatthis Waiver of Liability and Hold Harmless Agreement shall be construed in accordance withthe laws of the Commonwealth of Virginia. That in signing this release, you acknowledge and represent that you have READ IT, UNDERSTAND IT AND SIGN IT VOLUNTARILY as yourown free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreements, have been made; and you EXECUTE THIS RELEASE FOR FULL, ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY SAME.
